Refund and Returns Policy

This Refund Policy (“Policy”) is effective from 28/09/2023 and applies to online courses provided by Codelearn, owned and operated by Maciej Szwiec. By enrolling in any of our courses, you (“the Learner”) agree to abide by the terms set out in this Policy.

1. Scope and Application

This Policy sets forth the circumstances under which learners may be eligible to request a refund for online courses provided by Codelearn. The Policy applies to learners worldwide, including those in the United States, Australia, and Canada.

2. Cooling-Off Period

In compliance with the Consumer Rights Directive 2011/83/EU, namely Articles 9 through 12, learners are entitled to exercise their “Right of Withdrawal”. This right enables learners to cancel their course purchase and request a full refund within 14 days of the transaction without providing any justification. Nonetheless, this right is subject to a condition: a refund can only be claimed during this 14-day period provided that the learner has not accessed more than 25% of the course material. Beyond this threshold, the right of withdrawal may be lost.

3. Geographical Limitations

Codelearn, based in Europe, follows all European regulations.

However, we value our diverse community of learners from across the world, including the United States, Australia, and Canada.

For our European students, provisions related to the “Cooling-Off Period” are drawn from the Consumer Rights Directive 2011/83/EU to ensure that your legal rights are respected.

For learners in the United States, Australia, and Canada, our refund policies are primarily based on European regulations. Nevertheless, we recognize that each country has distinct consumer protection laws with varying refund provisions. Although we aim to establish a comprehensive, standardized reimbursement policy that upholds uniformity and impartiality for all our pupils, we urge non-European residents to familiarize themselves with their native consumer protection regulations. In situations where our norms and local laws clash, we will endeavor to tackle reservations in a way that acknowledges the learner’s prerogatives and does not compromise the essence of our policy. 4. Refund Eligibility

If, beyond the cooling-off period, learners encounter technical issues that prevent them from accessing or completing

  • The course and these issues remain unresolved by Codelearn, they may request a refund within 30 days of purchase.
  • Learners may also request a refund if the course content significantly deviates from its description and fails to meet reasonable quality standards; description and does not meet reasonable quality standards.

5. Exceptions

Refunds will not be granted if:

  • the learner has accessed over 25% of the course content or
  • if the learner has already received a course completion certificate.
  • course during a promotional period or at a discounted rate.

6. Refund Process

a. To request a refund, contact Codelearn at info@codelearn.pl and clearly state the reason for the request.
b. Refunds will be evaluated on a case-by-case basis.
c. Approved refunds will be processed within fourteen working days through the original payment method.

7. Refund Policy Amendments

Codelearn retains the right to modify its Refund Policy without prior notice. Any changes will be updated on the official Codelearn website, and students are encouraged to review the Policy regularly for updates.

8. Governing Law & Dispute Resolution:

This policy is subject to the laws of Poland. Any disputes related to this policy will be resolved through amicable negotiation, and if a resolution cannot be reached, the case will be referred to the Court of Arbitration at the Polish Chamber of Commerce in Warsaw. The arbitration proceedings will be carried out in compliance with the current Rules of the Court of Arbitration at the Polish Chamber of Commerce, effective from the start date of the arbitration.
